At about 11:30pm Wednesday night, Turlock Police responded to a dangerous driver at the Jack in the Box in the 1900 block of Lander Avenue, who had been swerving and was having a hard time speaking and standing.
Officer Lupe, who was responding to the call, observed the vehicle near N. Broadway and W. Olive Avenue after it had left the Jack in the Box. He attempted to make a traffic stop on it, however, its driver continued going northbound on N. Broadway before turning westbound onto Flower Street and finally coming to a stop just west of Lexington Avenue.
It was at that point that Lupe was notified by a driver who had followed them that she had been struck by the dangerous driver at Lander Avenue and D Street. The victim complained of pain.
Lupe contacted the dangerous driver and identified her as Jessika McCluskey, 31, of Turlock. McCluskey was displaying objective symptoms of being under the influence.
Officer Rocha responded to assist with the DUI investigation so that Lupe could focus on the collision investigation.
Rocha asked McCluskey if she’d be willing to participate in standardized field sobriety tests, however, she refused.
Based on the totality of the circumstances, Rocha determined that McCluskey was under the influence of alcohol and arrested her. McCluskey then began throwing a temper tantrum, lying on the sidewalk and yelling for her husband.
McCluskey had stopped across the street from her residence, so officers contacted her husband and had him come convince her to provide two breath samples as required by California’s implied consent law. McCluskey provided the first one, however, kept failing to provide a sufficient second one. After a few attempts, McCluskey gave up, threw herself back to the ground, and continued her tantrum.
Officers had to force McCluskey into the back of one of their patrol vehicles, where she began screaming.
McCluskey was transported to Doctors Medical Center where blood was forcefully drawn after a search warrant was obtained. She continued to scream while being transported and could be heard in the background of Rocha’s radio transmissions.
McCluskey was subsequently booked into the Stanislaus County Public Safety Center on charges of driving under the influence of alcohol causing bodily injury to another person, driving with a blood alcohol content of .08% or greater causing bodily injury to another person, and fleeing the scene of an accident resulting in injury to another person.
McCluskey’s vehicle was also impounded and she was issued a driver’s license suspension order.
