Ex-Pitman High School Teacher Carl Kubicek, 36 of Turlock, sought home detention instead of jail. Kubicek was arrested and found guilty of having unlawful sex with a minor involving a Pitman High School student.
Carl Kubicek was sentenced to seven months in jail for his two felony counts of unlawful sex and then given two more months in jail after he was caught violating his probation by coming in contact with his now 18 year old victim.
The sentence was so short mostly due to the fact the victim asked for leniency. The probation stipulation of not being able to contact the victim was also lifted now that she is 18 years old and apparently wants to see her former Pitman teacher who had sex with her at her home and in school.
Carl Kubicek wanted home detention but was denied and must serve his jail sentence. Kubicek must serve at least two thirds of his sentence. Kubicek may also apply for the alternative work program where he can live at home and do community service as part of the final three months of his sentence.
